General Terms and Conditions of Sale and Use

Welcome to your A’Corps Beauté boutique. By accessing our e-commerce site and placing an order, you accept these General Terms and Conditions of Sale (GTCS). Please read them carefully. Please also note that they may be updated, both in terms of content and in terms of functionalities or tools.

Your A’Corps Beauté e-boutique is hosted by WooCommerce, an open-source e-commerce platform enabling us to sell your products directly to you wherever you are.

1. Purpose

These Terms and Conditions apply, without limitation or qualification, to all sales of Products offered by A’Corps Beauté beauty salons and concluded only on the website www.boutique.acorpsbeaute.com to consumers.

Consequently, the fact that the Customer orders a Product offered for sale on the aforementioned website implies full acceptance of the present Terms and Conditions of Sale, which the Customer acknowledges having read prior to ordering. The applicable GCS are those in force at the time the order is validated.

2. Products

The products offered for sale on this website constitute the offer of A’Corps Beauté. The Boutique reserves the right to modify its proposals at any time and to change the list and ranges of Products.
The lists of ingredients used in the composition of the products promoted by the Boutique are regularly updated. Before using a product, please read the list of ingredients on its packaging (INCI list) to ensure that the ingredients are suitable for your personal use.
The photos of the Products presented on our site are not contractual. However, the Shop makes every effort to ensure that the photos and drawings faithfully reproduce the product offered and do not contain any ambiguities concerning notions such as size, weight and quality.

Rates

The sale price of the Products indicated in euros is that in force at the time the order is placed. These prices do not include shipping costs, which are invoiced in addition to the price of the Products purchased according to the terms defined below and as indicated to the Customer before the order is validated. Prices include the value-added tax (VAT) applicable on the day the order is placed.

The offers presented by the Shop are valid as long as they are announced on the site and within the limits of available stocks. Indications on the availability of Products are provided at the time the order is placed, where applicable.

3. Parties

Sales of products on the present site at www.boutique.acorpsbeaute.com are made by the company A’CORPS & BEAUTE (France) registered in the Nancy Trade and Companies Register under number 852 660 323 and whose head office is located in Nancy 54000 (hereinafter ACB).

CUSTOMER

ACB offers the sale of its Products on the website www.boutique.acorpsbeaute.com to consumers who have the legal capacity to place an order (hereinafter “Customer”). ACB cannot be required to verify the legal capacity of each Customer.

4.CGV : Order and Validation

ACB offers you the possibility of ordering by the means of your choice, in order to better satisfy you. In addition, customers can check the details of their proposed order during the validation phase and correct any errors.

From the moment the Customer confirms his/her order by clicking on the [“ORDER”] icon, he/she is considered to have accepted with full knowledge of the facts the content and conditions of the order, and in particular the present Terms and Conditions of Sale, the prices, volumes, characteristics, quantities and delivery times of the Products offered for sale and ordered by the Customer.

The sale will be final upon confirmation of the order by the Customer, without prejudice to the Customer’s right of withdrawal (see refund and return policy). Your items are then prepared for shipment. ACB reserves the right to refuse any order for legitimate reasons, in particular in the event of a previous dispute or definitive stock shortage. In the event of an order refusal, you will be notified of the reason for the refusal and also reimbursed up to the amount of your initial payment.

ACB will systematically confirm the order by sending an e-mail to the Customer containing all the information previously provided in the form of an invoice.

A second e-mail will be sent to the Customer when the order is dispatched.
ACB recommends that the Customer keep both e-mails on paper or in electronic form. The Customer is informed that both e-mails will be sent to the e-mail address entered by the Customer at the time of identification, prior to placing the order. ACB shall not be held liable in the event of an error in entering the e-mail address concerned, or in the event of non-receipt of the order confirmation e-mail.
ACB shall be entitled to collect the full price corresponding to the order:

  • for payments made by credit card: as soon as the e-mail informing the Customer that the order has been dispatched is sent.

5.CGV : Delivery

Place of delivery :

For Products, ACB delivers packages of Products in metropolitan France (including Corsica and Monaco) only. The Products will be sent to the delivery address indicated by the Customer at the time of ordering. Delivery charges are inclusive of all taxes.

Delivery times :

In the interests of quality and availability, the Mondial Relay and Colissimo carriers handle the transit of your products. Delivery times are :

  • Colissimo: 2 to 4 working days.
  • Mondial Relay: 5 to 7 working days.

Please note that these delivery times are provided as an indication only and Boutique A’Corps Beauté cannot be held responsible for delays due to carriers. The terms and conditions of delivery by our carrier partners are available in the shipping and delivery policy.

Late delivery

In the event of late delivery (delivery exceeding 30 days), the Customer may request ACB to effect delivery within a reasonable additional period. If ACB has not complied within this period, the Customer may cancel the order, unless Melvita has complied in the meantime or the delay in delivery is due to force majeure as defined below.

The order can be cancelled by :

If the order is cancelled, ACB will reimburse the Customer for all sums paid, at the latest within fourteen days of the date on which the contract was cancelled.

6. Withdrawal

The withdrawal period expires fourteen days after the day on which the Customer, or a third party other than the carrier and designated by the Customer, takes physical possession of the Products. To exercise the right of withdrawal, the Customer must notify ACB of his decision to withdraw from this contract by means of an unambiguous statement (e.g. letter sent by post, fax or e-mail). In order for the withdrawal period to be respected, it is sufficient for the Customer to transmit his communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period. ACB will reimburse the Customer using the same means of payment that the Customer used for the initial transaction. ACB may defer reimbursement until the Products have been received by the Boutique or until the Customer has proof of shipment of the Products, whichever comes first. The cost of returning the Products to ACB shall be borne by the Customer, except in the case of a defective Product.

7. GCS: Warranty and Liability

The legal guarantee of conformity applies to all products. The boutique A’Corps Beauté cannot be held responsible for any indirect damage linked to the use of the products. Sales of Products on the present site are subject to French law regardless of the Customer’s country of residence or the place of order. Any dispute relating to the existence, interpretation, performance or termination of a contract between the Customer and Melvita shall be subject to the exclusive jurisdiction of the French courts.

8. Intellectual Property

Please note that Boutique A’Corps Beauté is the exclusive owner of all content on this site (text, images, logo). Access to this website does not give you any rights to the intellectual property rights relating to the site, which remain the exclusive property of ACB. The general structure of the Site, as well as the elements accessible on the Site, notably in the form of texts, photographs, images (animated or not), icons, maps, sounds, videos, software, databases, data and all other elements making up the Site are the exclusive property of ACB. Any reproduction is forbidden without prior authorization.

9. Personal data

The use of the Boutique A’Corps Beauté necessarily involves the collection of digital data (cookies), which are processed in accordance with our privacy policy and are only used to manage the order.

YOUR OPINIONS ON OUR PRODUCTS

ACB undertakes to publish testimonials posted on the Site subject to compliance with the following moderation criteria: ACB reserves the right not to publish messages that are incomprehensible, outrageous, defamatory, malicious, racist or unrelated to the products in question. Furthermore, ACB reserves the right to modify the length, spelling or certain terms of testimonials for reasons of moderation or in order to improve the editorial consistency of the Site. Persons posting a testimonial grant ACB a worldwide license to reproduce, publish, translate and distribute their testimonial on all ACB media for the legal duration of the copyright. In the event that your testimonial is not published, we will endeavor to get back to you to find a better way of satisfying your needs. 10. CGV: TRANSACTION CONTROL

As part of the order control service, ACB may contact the Customer by any means, with a view to validating a transaction and may, if necessary, request any supporting documents deemed useful (relating to identity, and/or domicile and/or means of payment used). The Customer must provide the required proof within 15 working days of receipt of ACB’s request. The Customer is hereby informed that any delay, failure or refusal to provide the requested supporting documents will result in the cancellation of the order by ACB. Upon receipt of the supporting documents and in the event of confirmation of the order by ACB, the delay in transmitting the documents requested by the Customer will postpone delivery of the Product(s) ordered.

11. General Terms and Conditions: Disputes

In the event of a dispute, an amicable solution will be preferred. If no agreement is reached, the competent court will be that of the customer’s place of residence or our head office.
